Green Energy Open Access: UERC Captive Surcharge Ruling For Consumers

Captive power consumers, solar developers and regulatory professionals can review an Uttarakhand ruling affecting Green Energy Open access arrangements.
The case involves TVS Srichakra Limited and two Evincea solar companies, with disputed cross-subsidy, additional surcharge and network-charge recoveries.
The Green Energy Open access order preserves conditional historical adjustment or refund of Rs 39,31,267.73, subject to annual captive-status verification.
For Green Energy Open access transactions from 13 March 2026, qualifying consumers submitting the prescribed declaration are protected against advance collection of cross-subsidy and additional surcharges pending verification.
Failure of subsequent verification can permit retrospective recovery with applicable carrying cost.
The Commission also directed discontinuance of applicable transmission and wheeling charges and examination of past transmission recoveries.
The separate Rs 9,60,000 scheduling and system-operation refund was rejected.
Open Access Consumers should review eligibility, documentation and potential recovery exposure.
